Free Pilot Addendum

This addendum applies to named, free, manually issued pilot accounts ("Pilot Account") of System1 Models, provided by productivity-boost.com Betriebs UG (haftungsbeschränkt) & Co. KG, Reichenberger Str. 2, 94036 Passau, Germany ("we", "us"). It supplements the Terms of Service ("Terms"). A German version is available; if the two versions differ, the German version prevails.

P1. Scope and precedence

P1.1 This addendum applies only to a Customer for whom we have created a Pilot Account by hand, and only for as long as the Pilot Account exists. It does not apply to any other account.

P1.2 This addendum is part of the individual written agreement with the Customer within the meaning of section 15.5 of the Terms. Where it conflicts with the Terms, it prevails over sections 1.2 and 2.1 (creation of the account and conclusion of the contract), 3.3 (choice of tier), 4.2 (revocation in the dashboard), 5.1 to 5.7 (prepaid credit, payment, balance and invoices), 6.2 (acceptance of the Data Processing Agreement in the dashboard), 13.3 (refunds) and 14.1 (as far as it could be used to introduce charges) of the Terms. All other provisions of the Terms, the Acceptable Use Policy and the Data Processing Agreement remain unchanged.

P1.3 The paid, prepaid and self-service provisions of the Terms (in particular sections 2.1 second sentence, 5, and the references to the dashboard) are kept for possible future paid use. They do not apply to a Pilot Account while this addendum is in force, and their presence in the Terms does not mean that the corresponding features exist today.

P2. Account, acceptance and contract

P2.1 The Service is offered to businesses only (section 1 of the Terms). There is no self-service sign-up during the pilot. We create a Pilot Account by hand for a named Customer.

P2.2 Before we create a Pilot Account or issue an API key, the Customer must accept in text form (for example by email from the Customer's business address) (a) the Terms, (b) this addendum and (c) the Data Processing Agreement, each in the version we name in our request for acceptance. By doing so the Customer confirms that it acts in the course of its trade, business or profession and, if it acts for an organisation, that it is authorised to bind it (section 1.2 of the Terms). We may ask for evidence, such as a VAT ID or a company register entry.

P2.3 The contract is concluded when we have received the acceptance under P2.2 and confirm in text form that the Pilot Account has been created. Acceptance of the Data Processing Agreement takes effect on the same confirmation. We keep a record of the acceptance: date, accepting person and email address, and the accepted versions of the Terms, this addendum and the Data Processing Agreement.

P2.4 Until acceptance of the Data Processing Agreement has taken effect under P2.3, the Customer must not submit personal data to the Service (section 6.2 of the Terms). The acceptance in text form replaces the acceptance in the dashboard that the Terms and the Data Processing Agreement describe.

P3. API keys

P3.1 API keys are issued by us by hand and delivered to the contact address the Customer named. They are issued to the Customer, are personal to it and must not be shared beyond the persons and systems section 4.3 of the Terms permits.

P3.2 The Customer is responsible for keeping its keys confidential and for all use made with them until they are revoked. The Customer can revoke a key by asking us in text form at info@productivity-boost.com; there is no dashboard. We revoke the key without undue delay after we receive the request and confirm the revocation in text form. Tell us without undue delay if you suspect misuse.

P3.3 The models and tier available to a Pilot Account are those we state when we issue the key. They can be narrower than the offer described in section 3.3 of the Terms; the Customer does not choose a tier per key or per request itself.

P3.4 We may suspend or revoke a key under section 8 of the Terms and when the pilot ends under P6.

P4. No charges, no checkout, free allowance

P4.1 No fee is charged for the use of a Pilot Account. There is no checkout, no prepaid credit, no top-up, no payment through Stripe or any other payment provider, no balance and no invoice during the pilot. Sections 5.1 to 5.7 of the Terms do not apply. Prices published at /pricing are the launch rates for possible future paid use; they are shown for information and are not charged to a Pilot Account.

P4.2 We may grant a Pilot Account a free allowance of up to 100 million actual input tokens. The allowance is not guaranteed. It depends on our capacity and on the amount we confirm to the Customer in text form. It has no cash value, cannot be paid out, refunded or transferred, and we may reduce or withdraw it under P6. Actual input tokens are the input tokens our systems measure as processed for the Customer's requests, including tokens of images where the Service processes them.

P4.3 When the allowance is used up or withdrawn, requests may be rejected. No payment obligation arises from this, from exceeding the allowance or from ending the pilot.

P5. Usage information

P5.1 There is no customer dashboard, balance or invoice view during the pilot. The Customer can ask for a usage report by contacting us in text form at info@productivity-boost.com. We send the report within a reasonable time, on German business days, for the period requested.

P5.2 Usage is measured by our systems. Where the Customer disputes the figures, the Customer tells us in text form and we check them.

P6. Pilot status, changes and end

P6.1 The Pilot Account is provided as a limited free pilot. Section 3.5 of the Terms applies: it is provided without any availability commitment and may be changed or ended at any time. The targets in our Service Level Targets are goals only and give no rights during the pilot.

P6.2 We may end the pilot, reduce or withdraw the allowance, or change the models or limits of a Pilot Account. Where possible, we announce this by email in advance. The Customer may end its participation at any time by email to info@productivity-boost.com. Section 13.2 of the Terms remains unchanged.

P6.3 When a Pilot Account ends, we revoke its keys and delete account data as described in the Privacy Policy, subject to statutory retention periods. There is no credit to refund.

P7. Paid use only after separate notice and consent

P7.1 We will start charging a Customer, or offer a Pilot Account prepaid credit, checkout, self-service sign-up or a dashboard, only after we have sent the Customer a separate notice in text form that states the prices, the payment terms and the terms that then apply, and the Customer has given its explicit consent in text form. Silence is not consent. The Customer's continued use of the Pilot Account, the Terms' provisions on price changes (section 5.6) and the change procedure of section 14.1 of the Terms do not replace this consent.

P7.2 Sections 5.1 to 5.7 of the Terms apply to a Customer only from the date of that consent and only as the notice states. Until then, this addendum governs.

P8. Final provisions

P8.1 German law applies (section 15.1 of the Terms). The provisions of section 15 of the Terms apply to this addendum.

P8.2 If a provision of this addendum is or becomes invalid, the rest remains valid.
